Duty Free cigarettes and the Pact Act
The USA Federal PACT Act is now in effect.
Its key anti-smoker elements are:
1. The Shipping Obstacle:
The US Mail system can no longer deliver retail cigarettes or tobacco products in the USA.
2. Reporting Your Purchases for TAXATION:
ALL USA located vendors - including all those on Reservations - are REQUIRED TO REPORT all sales and customer details for after-purchase taxation.
The PACT ACT and Duty Free Cheap Cigarettes Sites
The Duty Free sites have no magic method of getting around anything in the USA to deliver tobacco products.
It's true that, just like with SSO, their overseas locations mean the PACT Act and USA law in general cannot reach them, but their packages still won't get delivered by mail.
Because they have no method to deliver in the USA, for them to continue promoting to the USA market, and to continue taking USA consumers' money, is 100% unconscionable and the worst of shoddy rip-off practice. It's indistinguishable from fraud, from theft.
Now, with the PACT Act in place, "Duty Free" is dead.
Not only did the PACT Act make it illegal to ship cigarettes by US Mail, it also actually forces the USPS to internally ban, report, inspect and seize all none compliant packages, and that does definitively emliminate the DF services.
Plus, under the PACT Act all sorts of government agencies, including Customs, are required to feed a single enforcement database under the control of the US Attorney General's office. And the Feds are required by the PACT Act to feed the info to State Attorneys General and the ATF for enforcement. In other words, when a DF company ships one package they're included in the Fed's data system. At the very least the package would be seized, and all future shipments would be red flagged.
In addition, if the DF folks were to try to switch shipping methods, we have confirmed that of all the international package handling companies that can deliver to consumers in the US - such as UPS, FedEx, DHL, TNT and others - none will accept cigarettes going into the USA unless the receiver can produce a valid US tobacco license at the time of delivery. Short of mis-declaring packages - which would be caught by random scans either by the carrier or US Customs - there is absolutely no way for the Duty Free vendors to continue servicing the market at all in the USA.
